A Touch Of Country – Lay-By Terms & Conditions

1. Lay-By Agreement

Lay-by is available on eligible products purchased from A Touch Of Country, both in-store and online.

By entering into a lay-by, the customer agrees to these Lay-By Terms & Conditions.

Goods placed on lay-by remain the property of A Touch Of Country until the lay-by has been paid in full.

2. Deposit & Payments

A minimum 20% deposit is required to commence a lay-by.

Customers may make additional payments at any time during the lay-by period.

All lay-bys must be paid in full within 8 weeks from the date the lay-by is commenced, unless otherwise agreed with A Touch Of Country.

The customer is responsible for ensuring payments are made within the agreed timeframe.

3. Collection of Goods

Goods will not be released until the lay-by has been paid in full.

Once the final payment has been received, the customer may collect their goods in-store or, for online lay-bys, the goods will be dispatched in accordance with the applicable delivery arrangements.

4. Cancelling a Lay-By

Customers may request to cancel their lay-by at any time before the final payment.

For a customer-initiated cancellation due to a change of mind, a 15% cancellation fee of the total original lay-by purchase price will apply.

The cancellation fee reflects the costs associated with processing the lay-by, reserving the goods and removing stock from sale during the lay-by period.

The remaining amount paid by the customer, after deduction of the cancellation fee, will be provided as A Touch Of Country store credit.

Store credit may be used towards future purchases at A Touch Of Country and cannot be exchanged for cash, except where required by Australian Consumer Law.

5. Missed Payments

If a payment is missed, A Touch Of Country may contact the customer to arrange payment.

If the lay-by remains unpaid for 14 days after the agreed payment date, A Touch Of Country may cancel the lay-by.

Where a lay-by is cancelled due to missed or overdue payments, the 15% cancellation fee of the total original lay-by purchase price will apply. Any remaining amount paid will be issued as store credit.

6. Lay-By Extensions

Extensions to the agreed lay-by period may be requested before the lay-by expires.

Any extension is at the discretion of A Touch Of Country and must be agreed to before the original due date.

7. Sale Items & Promotional Pricing

Items purchased on lay-by are secured at the price shown when the lay-by is commenced.

If an item subsequently goes on sale or is subject to a promotion, the lay-by price will not automatically be reduced.

Promotional discounts cannot be applied retrospectively to an existing lay-by unless otherwise agreed by A Touch Of Country.

8. Changes to Lay-By Items

Items cannot be added to, removed from or exchanged within an existing lay-by without approval from A Touch Of Country.

If items are removed from a lay-by at the customer's request, the transaction may be treated as a cancellation and the applicable 15% cancellation fee may apply.

9. Faulty or Incorrect Goods

Nothing in these Lay-By Terms & Conditions limits, excludes or modifies any rights the customer has under the Australian Consumer Law.

If goods are faulty, do not match their description, or otherwise fail to meet the consumer guarantees under Australian Consumer Law, the customer may be entitled to a repair, replacement, refund or other remedy as required by law.

10. Refunds

Except where a refund is required under Australian Consumer Law, customer-initiated lay-by cancellations will be subject to the applicable cancellation fee and the remaining amount paid will be issued as store credit.

Where a refund is legally required, it will be provided in accordance with Australian Consumer Law.

11. Lay-By Records

Customers should retain their lay-by receipt or confirmation and payment records.

A Touch Of Country will maintain records of lay-by payments and the outstanding balance.

12. Acceptance of Terms

By commencing a lay-by with A Touch Of Country, the customer acknowledges that they have read, understood and agreed to these Lay-By Terms & Conditions.

A copy of these terms is available in-store and on our website.

A Touch Of Country reserves the right to refuse a lay-by where appropriate.
